Terms and Conditions
Introduction
These Terms and Conditions apply to the website and transactions related to MM Digital’s marketing services. Additional contracts related to your relationship with us, including any signed client agreement, may also apply. Where any provision of a signed client agreement conflicts with these Terms, the provisions of that signed agreement will take precedence.
Binding
By registering with, accessing, or using this website, you agree to be bound by these Terms. Using the website implies acceptance of these Terms and Conditions. In some cases, you may be asked to explicitly agree.
Electronic Communication
By using our website or communicating with us electronically, you acknowledge that we may communicate with you via email or other electronic means. These communications will satisfy any legal requirements, including the need for written communication.
Intellectual Property
All content, data, and resources on the website are owned by MM Digital or its licensors. You may not use, copy, reproduce, alter, or distribute any of these resources without prior written permission from MM Digital, unless otherwise permitted by law.
Newsletter
You may forward our newsletter to others who might be interested in our services, but any other use of our content must comply with these Terms.
Third Party Property
Our website may contain links to third party websites. We are not responsible for the content or privacy practices of these sites and do not endorse them. You bear the risk of engaging with any third party services linked from our site.
Responsible Use
You agree to use our website only for lawful purposes, in line with these Terms and applicable laws. Unauthorised use of the website, including publishing harmful content or engaging in data collection activities, is prohibited.
Registration
By registering an account with MM Digital, you are responsible for maintaining the confidentiality of your account details and passwords. You agree not to share these details with others, and to notify us immediately if there is any unauthorised use of your account.
Refund and Return Policy
Right of Withdrawal (Consumers)
Where you are a consumer and are entitled to a statutory right of withdrawal under applicable law, you have the right to withdraw from a contract with MM Digital within the statutory period, without reason. To exercise this right, you must notify us in writing, and we will acknowledge receipt. If you choose to withdraw, we will reimburse any payments received, less any applicable fees for services already performed.
Business Clients
Where you engage MM Digital as a business, the terms of your signed client agreement, including its notice period, pause policy and payment terms, apply to the cancellation of services, and this withdrawal provision does not apply. Your signed agreement takes precedence in all such cases.
Effects of Withdrawal
Where a valid statutory withdrawal applies, we will reimburse payments made within 14 days. If services have already been provided, the reimbursement will be adjusted according to the value of the service rendered.
Content Posted by You
Any content you post on our website must comply with these Terms. We reserve the right to monitor and remove content at our discretion if it violates our policies.
Idea Submission
Please do not submit intellectual property ideas or inventions unless we have a prior agreement in place. Without such an agreement, any submissions will be considered licensed to MM Digital, allowing us to use the material in any form.
Termination of Use
MM Digital reserves the right to modify, suspend, or discontinue your access to the website or services, temporarily or permanently, without notice. We are not liable for any loss or damages resulting from such actions.
Warranties and Liability
Our website and its content are provided “as is”, without any warranties. MM Digital is not liable for any damages arising from your use of the website, including lost profits or data loss. Our total liability to you for any claim arising out of or in connection with our services is limited to the fees paid by you for the services in the three months preceding the claim, in line with your signed client agreement where one is in place.
